What are my rights in NYC if my paycheck bounces?
I work for a small company owned by 2 senior partners. As the bookkeeper, I’ve noticed that our checking account is at $5,000 and our payroll is $28,000 per month! HELP! I don’t think I’m going to get paid next month. What happens if my paycheck bounces? What happens if I don’t get paid? Can I file for unemployment? Anyone in New York City been in this position before?
I know you can’t collect unemployment if you quit. But if your employer can’t pay you, are you considered laid off? If I quit and don’t find work, I’m screwed – I don’t have much in savings due to my upcoming wedding and some health problems earlier this year. I’m really scared.
Any advice would help. I’ve got my job hunt started already. I’m just worried about losing pay or having to wait for it if I don’t find work right away.

The partners know – I work for a small company of 9 employees. The senior partner looks at the books all the time. He is withholding payments to vendors – probably so that he can pay us. But we are not estimating jobs, we’re not billing, and we have $75,000 in client invoices that we’re waiting for payment on. That ain’t gonna float us!!!!

Can a job withhold health savings money from you?
This is quite a dilemma.
My previous company had a HSA (Health Savings Account) system attached to her our insurance plan. They would take X amount of money out of our check and would match the same amount and that would be placed into her HSA account at a certain point in time.
Now, my first year there we didn’t see anything placed in there for the first year until the second year, and it wasn’t even the full amount we were owed! The last 2 years we had the plan, the money was never given to us. A co-worker at the time would ask and ask because he had some serious medical bills to pay, and eventually he was let go and still hassles the company.
A month ago, I was laid off as well (and I now work for an AWESOME company). A few days after I departed with them, I politely sent an e-mail and inquired about the money I am owed. The owner mentioned he will speak to his accountant. He still has not gotten back to me and I simply want to end all ties and move on after all the years of abuse (more to the tale, but off subject).
Anyways, what steps should I be taking to get my money? Small claims, IRS? I’d appreciate any help I could get.

paystubs showed deductions being made and I saved 90% of paystubs for the 4.9 years I worked there.

is there anyone who can help me get my employee medical insurance right?
I have a Kaiser HSA medical plan with my employer. We our small company began the medical insurance for all the employees, we all recieved a notice stating that $98.00 a month would be taken out and a HSA (Health Savings Account) would be started. That was July 2007 and I have yet to get my boss to do this!!! IT IS DRIVING ME CRAZY!! Is there anything I can do legally to get my boss to complete this task? I do not have a health benefit person or an HR person in our company to go to about this. This not the first item my boss slacks on, and I know it wont be the last. I am now in collections with my insurance carrier becasue I cannot afford to pay $700.00 every time I go to the doctor. I already pay the full co-pay and full prescription price. The remaining balance is what I owe to Kaiser since no one takes out the monthly premium out of my check. HELP!!
